Terms of Service for N D Counselling and Personal Development Coaching

1. Agreement and Parties
These Terms of Service (“Agreement”) are entered into between N D Counselling and Personal Development Coaching (“Provider,” “we,” “our,” or “us”) and you, the client or user of our services (“Client,” “you,” or “your”). This Agreement governs your use of our counselling and coaching services, website, and any related materials or resources.

2. Grant of Rights
Subject to this Agreement, we grant you a limited, non-exclusive, non-transferable right to receive our counselling and coaching services as outlined in your service package.

3. Payments
3.1 Fees: Clients agree to pay for services as per the rates and schedule outlined in their service agreement.
3.2 Taxes: Fees do not include applicable taxes. You are responsible for paying all taxes associated with your purchase.

4. Client Obligations
You agree to:
a) Provide accurate information
b) Attend scheduled sessions punctually
c) Engage in the counselling and coaching process in good faith
d) Complete any assigned tasks or exercises
e) Maintain the confidentiality of our sessions and materials

5. Limited Warranty
We warrant that our services will be performed in a professional manner consistent with industry standards. This is the only warranty provided and is in lieu of all other warranties, express or implied.

6. Term and Termination
6.1 Term: This Agreement is effective from the date you begin using our services and continues until terminated.
6.2 Termination: Either party may terminate this Agreement with written notice. We reserve the right to terminate services immediately if you violate these terms.

7. Intellectual Property and Confidentiality
7.1 Ownership: All materials, methodologies, and content provided by us are protected by copyright and other intellectual property laws.
7.2 Confidentiality: You agree to maintain the confidentiality of all information shared during sessions and in our materials.

8. Limitation of Liability
Our liability is limited to the amount paid for services in the 12 months preceding any claim. We are not liable for any indirect, incidental, or consequential damages.

9. Indemnification
You agree to indemnify and hold us harmless from any claims arising from your use of our services or violation of these terms.

10. General Provisions
10.1 Governing Law: This Agreement is governed by Queensland, Australia.
10.2 Dispute Resolution: Any disputes shall be resolved through arbitration in [insert location].
